Illegal acquisition, possession, and transportation of narcotic drugs or psychotropic substances with intent to sell, committed in large quantity (Article 234.4.3 of the Criminal Code of the Republic of Azerbaijan)

Conviction and Sentence:

On 16 January 2023, the Baku Assize Court found Jafar Mirzayev guilty under Article 234.4.3 and sentenced him to 6 years’ imprisonment.

On 16 March 2023, the Baku Court of Appeal reduced the sentence to 5 years’ imprisonment, leaving the remainder of the judgment unchanged.

On 9 January 2024, the Supreme Court of the Republic of Azerbaijan dismissed his cassation appeal and upheld the appellate decision, thereby maintaining the 5-year prison sentence.

Political Prisoner Status:

His detention meets criteria (a) and (e) of PACE Resolution 1900 (2012):

  • Violation of fundamental rights under the European Convention on Human Rights (ECHR), including freedom of expression and association, the right to liberty and security, and the right to a fair trial.

  • Politically motivated prosecution (ulterior purpose): The criminal proceedings appear to have been pursued primarily to punish and deter his opposition-linked activities, diaspora engagement, and online criticism of the Azerbaijani authorities.

His case is widely regarded as part of a broader pattern in which opposition supporters and individuals returned or deported from Germany are charged with serious narcotics offenses shortly after their return to Azerbaijan.

Summary:

Jafar Mirzayev is an Azerbaijani opposition-aligned activist and former political migrant (2014–2021) who resided in Germany, where he remained politically active through Facebook commentary and participation in diaspora demonstrations, including protests calling for the release of political prisoners.

He was repatriated to Azerbaijan in November 2021 and detained on 27 January 2022. One day later, a court ordered his pre-trial detention. Authorities accused him of possessing narcotics with intent to sell in large quantity under Article 234.4.3.

Mirzayev has consistently denied the charges, asserting that the narcotics were planted and that his early incriminating statements were extracted under pressure, threats, and ill-treatment. The prosecution relied almost exclusively on police-generated operational information, search and seizure protocols conducted inside a police facility, and state forensic reports confirming only the type of the seized substances. Courts dismissed his allegations of coercion without conducting an independent and effective investigation.

His case is publicly discussed as part of the so-called “deported from Germany” drug-case pattern, involving other opposition-affiliated returnees who were similarly charged with serious narcotics offenses after their return.

The proceedings formed part of a broader wave of repression against opposition members, independent media, civil society actors, and returned diaspora activists that intensified from 2022 onward. International human rights organisations, including Human Rights Watch, have characterised similar prosecutions in Azerbaijan as politically motivated and emblematic of a wider crackdown on dissent.
