Illegal acquisition, possession, and transportation of narcotic drugs or psychotropic substances with intent to sell, committed in large quantity (Article 234.4.3 of the Criminal Code of the Republic of Azerbaijan)

Conviction and Sentence:

On 21 October 2022, the Sumgayit Assize Court found Mutallim Orujov guilty under Article 234.4.3 and sentenced him to 7 years’ imprisonment.

On 1 March 2023, the Sumgayit Court of Appeal upheld the verdict.

On 1 February 2024, the Supreme Court of the Republic of Azerbaijan dismissed the cassation complaint and left the judgment unchanged, keeping the 7-year sentence in force.

Political Prisoner Status:

His detention meets criteria (a) and (e) of PACE Resolution 1900 (2012):

  • Violation of fundamental rights under the ECHR, including freedom of expression and association, the right to liberty and security, and the right to a fair trial.

  • Predominant political motive (ulterior purpose): the proceedings appear aimed at punishing and deterring him for his opposition affiliation and diaspora-based political activity, including online criticism while in Germany.

His case is widely discussed as part of the “returned/deported from Germany” pattern, in which opposition-affiliated returnees are prosecuted on spurious large-quantity/intent-to-sell drug charges shortly after return.

Summary:

Mutallim Orujov is an Azerbaijani opposition activist and long-time member of the Popular Front Party (AXCP/PFPA). He emigrated to Germany in 2016 (with his two sons), remained politically outspoken online while abroad, and was repatriated to Azerbaijan on 1 June 2021.

He was detained on 23 October 2021 in the Guba district during a police operation and taken to the Guba District Police Department, where a personal search was conducted and narcotics were allegedly seized. On 24 October 2021, a court ordered four months of pre-trial detention.

Orujov has consistently denied the allegations, stating that drugs were planted and that incriminating statements were extracted under coercion and intimidation. The courts relied overwhelmingly on police-generated procedural documents, police testimony, and state forensic findings confirming only the type/weight of the seized substance, while failing to conduct an effective, independent examination of his ill-treatment allegations or the integrity of the search-and-seizure process.

His prosecution is widely regarded as politically motivated and aligned with a broader crackdown on dissent, and it is repeatedly referenced as part of a wider pattern of narcotics cases against opposition-linked deportees/returnees from Germany.
